Quick Summary: Use our apps responsibly, pay for what you use, and we'll provide reliable service. We're not liable for damages beyond our control, and disputes are resolved under German law.

1. Acceptance of Terms

By installing or using any SolvexApps applications ("Apps"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use our Apps.

These Terms apply to:

  • Solvex Estimated Delivery Date
  • All current and future SolvexApps applications
  • All related services and support

2. Service Description

What We Provide

Our Apps provide functionality for Shopify stores including:

  • Estimated delivery date calculations and display
  • Theme integration and customization tools
  • Analytics and usage tracking
  • Customer support and documentation

Service Availability

We strive to maintain 99.5% uptime but cannot guarantee uninterrupted service due to:

  • Planned maintenance and updates
  • Third-party service dependencies (Shopify, hosting providers)
  • Circumstances beyond our reasonable control

3. User Responsibilities

Proper Use

You agree to:

  • Use our Apps only for legitimate business purposes
  • Provide accurate information during setup and billing
  • Comply with Shopify's Terms of Service and policies
  • Not attempt to reverse engineer or hack our Apps
  • Not use our Apps for illegal or harmful activities

Your Data & Content

You are responsible for:

  • The accuracy of delivery information displayed to customers
  • Compliance with local laws regarding delivery promises
  • Your store's privacy policy and customer communications
  • Backup of your app settings and configurations

4. Billing & Payments

Subscription Plans

  • Free Plan: 2,000 monthly calls, basic support
  • Basic Plan: $10/month, 10,000 calls, priority support
  • Pro Plan: $25/month, 80,000 calls, priority support
  • Premium Plan: $39/month, unlimited calls, priority support

Payment Terms

  • All paid plans include a 14-day free trial
  • Billing is processed monthly through Shopify
  • Usage limits reset on your billing anniversary
  • Failed payments may result in service suspension

Refunds

Refunds are provided:

  • During the 14-day trial period (no questions asked)
  • For technical issues preventing app use (at our discretion)
  • For billing errors or duplicate charges
  • Refunds are prorated for unused service periods

5. Intellectual Property

Our Rights

SolvexApps retains all rights to:

  • App source code, algorithms, and trade secrets
  • SolvexApps trademarks, logos, and branding
  • Documentation, tutorials, and support materials
  • Aggregated and anonymized usage data

Your Rights

You retain ownership of:

  • Your store data and customer information
  • Custom messages and content you create
  • Your Shopify store and its content

License

We grant you a limited, non-exclusive, non-transferable license to use our Apps for your Shopify store while your subscription is active.

6. Privacy & Data Protection

Our data practices are governed by our Privacy Policy, which includes:

  • GDPR compliance for European users
  • Minimal data collection necessary for service operation
  • Secure data storage and transmission
  • Your rights to access, modify, and delete your data

7. Limitation of Liability

What We're Not Responsible For

To the maximum extent permitted by law, we are not liable for:

  • Lost profits, revenue, or business opportunities
  • Indirect, incidental, or consequential damages
  • Customer disputes related to delivery promises
  • Issues caused by third-party services (Shopify, themes, other apps)
  • Data loss due to user error or external factors

Maximum Liability

Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim, up to a maximum of $500.

Important: Some jurisdictions don't allow limitation of liability, so these limits may not apply to you. You always retain rights under applicable consumer protection laws.

8. Termination

By You

You may terminate your use of our Apps at any time by:

  • Uninstalling the app from your Shopify store
  • Canceling your subscription
  • Contacting our support team

By Us

We may suspend or terminate your access if:

  • You violate these Terms of Service
  • Your payment fails repeatedly
  • You engage in fraudulent or abusive behavior
  • Required by law or legal process

Effect of Termination

  • Your access to the Apps will cease immediately
  • Your data will be deleted after 90 days
  • Outstanding charges remain due
  • These Terms survive termination where necessary

9. Modifications to Service & Terms

Service Changes

We may modify our Apps to:

  • Add new features and improvements
  • Fix bugs and security issues
  • Comply with legal requirements
  • Maintain compatibility with Shopify updates

Terms Changes

We may update these Terms with 30 days notice:

  • Email notification to active users
  • Updated terms posted on this page
  • Continued use indicates acceptance

10. Governing Law & Disputes

Applicable Law

These Terms are governed by German law, without regard to conflict of law principles.

Dispute Resolution

For disputes:

  • First step: Contact our support team for informal resolution
  • Mediation: We encourage mediation for faster resolution
  • Jurisdiction: German courts have exclusive jurisdiction

EU Users

EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SolvexApps.

Severability

If any part of these Terms is found unenforceable, the rest remains in full effect.

Force Majeure

We're not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, government actions, etc.).

Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations to affiliates or in connection with a business transfer.
